Winter holidays abroad - with or without travel?

Winter in the Czech Republic is slowly coming to an end, but in high alpine resorts the season is in full swing. If you go skiing abroad, you have a choice of several choices. You can book a complete tour at the travel agency, or use only some of the services offered, or go out on your own. What are the advantages and disadvantages of different versions of winter holiday abroad?

In order for a tour to really be called a tour, it must consist of more tourist services (including transport, accommodation and other services) and last at least 24 hours. "If you are traveling with a Czech travel agency, the Czech law applies to the trip even though the services are provided abroad," says Lukáš Zelený, head of the Legal Department of the consumer organization dTest, adding: "On the contrary, if you choose a foreign travel agency, usually govern the law of that state. "

If you are dissatisfied with the quality of the services provided during the trip, you should be denied on the spot at a travel agent delegate or at the hotel reception. The organizer is obliged to provide a remedy and, if he does not do so in good time, you can arrange it at his own expense. Please submit your complaint within one month of the end of the trip, otherwise you will not be able to get discounts. In case of serious deficiencies, you may also want to compensate for the so-called loss of pleasure from your vacation.

If you only travel in Austria for a holiday home in Austria, it is not a tour in the true sense of the word. As a result, among other things, you will find it difficult to seek redemption after your return, and if the travel agency fails, you will not get a refund from the insurance company.

When you look for accommodation through brokerage sites like booking.com, there will also be no tour. "It should be borne in mind that in such a case, you are entering into a contract directly with the accommodation facility to which the agent has just left you. This contract will not be governed by Czech law, but by the law of the country you are traveling to, " adds Lukáš Zelený, adding: " This is subject to specific conditions for cancellation of the reservation and also for local taxes connected with accommodation, which is reasonable to always check in advance . "

It does not mean, however, that the intermediary did not respond at all to anything. By law, it must ensure that it allows contracts only with trusted entities. He can not even suggest signing a contract with a third person who has doubts about whether he will comply with the contract. If he did, you can claim a damages claim just after the intermediary.

But certainly for a specific offer, consider whether it is really good enough to balance the legal uncertainty. Intermediary servers, travel agencies or hotels may attract lesser travel costs than travel agents, but solving subsequent problems can be costly. To resolve disputes with companies from other Member States of the European Union, Iceland or Norway, you can use the services of the European Consumer Center.
